Definitions

Chamber: Madinah Chamber of Commerce and Industry.

Website: A website owned by the Al Madinah Al Munawarah Chamber through which the Chamber offers digital services.

User: Any natural or legal person who benefits from the e-services offered by the Chamber via the website, whether registered or not.

Introduction

The Chamber offers its e-services via the website and are available for use by everyone.

The user's access to and use of this website is subject to the terms and conditions set forth herein.

The services and information available on the website and the terms and conditions of use are subject to the laws and regulations of the Kingdom of Saudi Arabia, including, but not limited to the communications regulation, the e-transactions regulation, the anti-cybercrime regulation as well as the Chamber’s regulations and procedures related to domain names. They shall be interpreted in accordance with them.

The user's access to and use of the website constitute his acceptance of these terms and conditions without restrictions or conditions.

Login to the website

The use of e-services requires access to the website. There are no current fees for login to the website, but the Chamber’s website shall reserve the right to impose registration fees in the future.

The user code and password shall be chosen by the user and they shall be used by him only. They constitute a protection tool for accessing his data management area through which his domain names are managed or those he authorized others to manage.

The user shall be responsible for maintaining the user code and the confidentiality of the password. He shall also accept full responsibility for any operation or service request that the Chamber receives under his user code and password, even if it is not intended or he is not the one who made it.

The user's user code, password, and email address are very important and must be preserved. When they are forgotten or others attack them, the user must follow the website's relevant procedures so that his information and services are not changed or used by others.

The access of registered users to the website can be terminated by them at any time. The Chamber may also terminate, suspend or restrict the right to access the website at any time in the event of a violation of the terms and conditions of use.

The Chamber employees do not ask users to disclose their passwords under any circumstances.

Some operations on the website require the use of a one-time authorization code (security key). It is an additional security procedure that is implemented to protect some operations. It shall be used with caution and as per the instructions attached to it.

User Obligations

The user shall acknowledge that any information he or she submits via the website is complete, accurate, and up-to-date. He shall also bear responsibility for the content of any information or document submitted via the website. The user shall not log in to or access the website impersonating another user.

The user shall acknowledge that he will not represent any natural or legal person without being authorized to do so.

The user shall acknowledge that logging in to and using the website will be for lawful purposes only. He shall undertake not to use the website or the information, services or tools available on it to carry out any action that results in a violation or crime under any law applicable in the Kingdom of Saudi Arabia, regardless of whom that violation or crime is leveled at.

The Content

The name of the Chamber (Al Madinah Al Munawarah Chamber of Commerce and Industry), its logo, the Chamber’s e-addresses, and everything contained on the website in terms of materials, texts, images, drawings, designs, models, multimedia files, software, and their tabulations are owned by the Chamber. The Chamber shall reserve all intellectual property rights related to them, including copyrights and distribution. It is not permitted to reprint, distribute, modify, use these materials for commercial or advertising purposes, or republish them in any form without obtaining explicit written permission from the Chamber.

The Chamber reserves the right to monitor any content entered by the user.

The Chamber reserves the right (but has no obligation) to delete, remove or edit any entries that violate these terms and conditions.

The Chamber reserves the right to delete any information that it considers to be in violation of any of the terms and conditions of use without notice.

The contents and tools on the site are provided to users as is, without warranties of any kind, whether express or implied.

Some links on the site may lead to websites that are not operated by the Chamber, and over which the Chamber has no control. The Chamber also does not review or control the content of those sites. They are provided as a convenience to users, and these links have no content. Promotional for goods, services or information, which does not involve any link between the chamber and the operators of the linked sites, and when the user chooses a link to an external site, he is subject to the terms and conditions of that external site.

Any information or materials sent to the Chamber via the Internet through the website become the property of the Chamber.

Terms of use of information

The Chamber website is permitted to use any of the information that is submitted by users or that which the user stores in his personal file. It can be used for any purpose linked to the website or any of its subsidiaries. The user shall be entirely responsible for all the information that he publishes on the website. The Chamber website shall not be liable for any factual distortions or other errors in this content.

Compensation

The user shall undertake not to take any action against the Chamber’s website or any of its administrators as well as any entities, employees, or operators who are responsible for managing, maintaining, or updating the Chamber’s website, regarding all the obligations and responsibilities that may arise in connection with any claim arising from the user’s breach of the terms and conditions of use or any applicable laws in the Kingdom of Saudi Arabia.

Guarantee

The Chamber seeks to provide safe access to the website and the services offered by it. However, as a result of reasons beyond the Chamber’s control, the Chamber shall not guarantee continuous, free, uninterrupted and safe access to the website or any of its services, nor is the Chamber liable for any discontinuance, delay or malfunction of the services provided via the website.

The user shall acknowledge that his use of the website or any material available on it is subject to his own responsibilities. Neither the Chamber nor any of its employees shall guarantee that the website will not be prone to downtime or that it will be free of problems, deletions or errors. The result that the user will reach as a because of using or logging in to the website shall not be guaranteed.

The Chamber has taken all appropriate measures to place the information on the website and will attempt to update this information as soon as possible. However, the website does not give any explicit or implicit guarantees regarding the accuracy of the published information, its agreement with the reality of the situation, or its completeness.

Limits of liability

The Chamber shall not be liable for any loss of profits or any loss of any kind as a result of the information or services it provides.

The Chamber shall not be liable for any loss, modification, or damage to user data stored on the website, which results in an unauthorized person obtaining the right to access user data stored on the website.

Regardless of the case or circumstances, the Chamber shall not be liable for any of the following matters, but not limited to: negligence that results in any damages or harm of any kind, whether direct, incidental, special or consequential, or any expenses or losses that may result due to the user's use of the website or the inability to use it, the occurrence of some errors or omissions, or a delay in the system's response for any reason, an interruption in operation, the occurrence of malfunctions, computers being exposed to viruses, a complete system failure, the loss of any profits, or the user's reputation being harmed. Even if we have been explicitly notified of the possibility of such matters occurring, or problems arising as a result of accessing, logging in to or using the website or accessing other websites via it.

Prohibited use

The use of the website is permitted only for lawful purposes and therefore it is forbidden to use the website:

In any way that is illegal or fraudulent, or associated with any unlawful or fraudulent purpose or effect.

For the purpose of causing harm or attempting to harm others in any way.

With intent to transmit any data or send or upload any material that contains viruses, harmful materials or software of any kind or similar computer code designed to adversely affect the operation of any computer software or hardware.

Not to reproduce, duplicate, copy or resell any part of the website in violation of the terms and conditions of use.

Not to gain unauthorized access to, interfere with, damage or disrupt:

As regards privacy and Confidentiality Statement, we recognize your concerns about the privacy of your data on the Internet.

This policy has been developed to help you understand the nature of the data we collect from you when you visit our website and how we deal with these personal data.

Browsing

We did not design this website in order to gather your personal data from your personal computer while you are browsing this website. The data submitted by you will only be used with your knowledge and of your own free will.

Modification

The Chamber has the right to modify these terms and conditions or replace them with other new terms and conditions without notice. The modifications come into effect immediately upon their publication on the website unless otherwise stated. The user’s continued access to the portal or use of the services offered by the portal shall mean his consent to these changes.

AlMadinah AlMunawarah Chamber has the right to modify, discontinue or suspend all or part of the website temporarily or permanently without prior notice and at any time it deems appropriate. The Chamber shall not be liable towards the user or any other parties for any modification to, discontinuation or suspension of the portal.
